General Conditions of Sale (GCS)

This document establishes the contractual conditions applicable to any purchase made on the site www.onyxelle.com .

Article 1 – Principles

These general terms and conditions of sale (GTC) apply to all sales concluded on the ONYXELLE website. They express the entirety of the parties' obligations and are deemed to be accepted without reservation by the buyer at the time of the order. ONYXELLE reserves the right to modify its GTC at any time. The applicable GTC are those in effect on the day of the order.

Article 2 – Products and services

The products governed by these General Terms and Conditions are those presented on the site as sold by ONYXELLE. They are offered while stocks last (stock in France and, for certain items, direct shipping from our international supplier). The essential characteristics are described with the greatest possible accuracy. The photographs are not contractual.

Article 3 – Price

Prices are listed in euros (€), inclusive of all taxes (VAT included where applicable). Delivery charges for mainland France are included in the displayed price, unless otherwise stated. For deliveries outside France, taxes, customs duties, or additional fees may apply and are the customer's responsibility.

Article 4 – Order

Orders are placed online from the catalog available on the website. To confirm their order, the customer must:

  • Accept these T&Cs,
  • Provide a valid delivery address,
  • Validate the chosen payment method.

The sale is deemed final after sending the order confirmation email and payment of the price.

Article 5 – Payment

Payment is due immediately and in full upon ordering. Accepted payment methods are: credit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, and Google Pay. The customer guarantees that they have the necessary authorizations to use the chosen payment method. In the event of refusal or payment anomaly, the order is automatically canceled.

Article 6 – Delivery

Deliveries are made within mainland France. Some items are shipped from our warehouse in France; others may be shipped directly from our international supplier. Approximate delivery times are specified on the product pages and in the confirmation email. In any event, the maximum delivery time will not exceed 30 business days after order validation, in accordance with the law. In the event of a significant delay, the customer may request cancellation of the sale and obtain a refund.

Article 7 – Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of their order to exercise their right of withdrawal without having to provide a reason. To exercise this right, the customer should contact customer service at contact@onyxelle.com . Unless otherwise indicated, returns should be made to the following address:

Products must be returned in their original condition, complete and unworn (except for simple fitting), with labels and packaging where applicable. For hygiene reasons, certain items cannot be returned (e.g. underwear, swimwear from which the hygienic protection has been removed). Unless there is an error on our part or a defective product, the return costs remain the responsibility of the customer. Reimbursement will be made within a maximum of 14 days from receipt of the returned and verified items, via the same payment method used for the purchase.

Article 8 – Legal guarantees

The products benefit from legal guarantees:

  • Legal guarantee of conformity (articles L. 217-3 et seq. of the Consumer Code), valid for 2 years from delivery of the goods.
  • Guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

In the event of a defect, the customer may request compliance, replacement or, failing that, a reduction in price or cancellation of the sale, in accordance with legal provisions.

Article 9 – Intellectual property

All elements of the website www.onyxelle.com (texts, images, logos, graphic charter, databases, etc.) are protected by intellectual property law and remain the exclusive property of ONYXELLE. Any reproduction or representation, in whole or in part, is prohibited without prior authorization.

Article 10 – Personal data

Personal data is processed in accordance with our Privacy Policy and the GDPR. The customer has the rights of access, rectification, erasure, opposition, limitation and portability, which he can exercise by writing to contact@onyxelle.com .

Article 11 – Mediation and dispute resolution

In the event of a dispute, the customer will first contact customer service to seek an amicable solution. In the absence of an amicable agreement, the customer may resort to a competent consumer mediator free of charge or use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr . These T&Cs are subject to French law and the French courts have jurisdiction.
