Terms and Conditions of Sale (T&Cs)

This document sets out the contractual conditions applicable to any purchase made on the website www.onyxelle.com (“the Site”), operated by ONYXELLE. By confirming an order, you unconditionally accept these T&Cs.


Article 1 – Principles

These T&Cs apply to all sales concluded via the Site to the countries served. They represent the full obligations of both parties and are binding upon the customer at the time of order. ONYXELLE may update these Terms at any time; the applicable version is the one in effect on the date of purchase.


Article 2 – Products & Availability

The products offered are those listed as sold by ONYXELLE. They are available while stocks last (inventory in France and, for some items, direct shipping from international logistics partners). Essential characteristics are described as accurately as possible; photographs are for illustration only.

ONYXELLE reserves the right to limit quantities and/or discontinue an offer at any time.


Article 3 – Prices, Taxes & Currencies

Prices are displayed in the local currency based on your country (EUR, CHF, or USD via Shopify Markets). Unless otherwise stated, prices include applicable taxes in the relevant region:

  • EU: VAT included, collected under OSS/IOSS rules.
  • Switzerland: import duties and taxes may be charged upon receipt (customer’s responsibility unless stated otherwise at checkout).
  • United States: state sales tax calculated at checkout based on the delivery address.

Shipping fees apply based on country and chosen method (see Article 6). Prices may change at any time but will not affect confirmed orders.


Article 4 – Orders

Orders are placed online through the Site’s catalog. To confirm an order, the customer must: (i) accept these T&Cs, (ii) provide accurate contact details, (iii) confirm the delivery method, and (iv) validate payment. The sale becomes final upon confirmation email and full payment receipt.

ONYXELLE reserves the right to refuse or cancel any order for legitimate reasons (error, prior dispute, suspected fraud, product unavailability, etc.).


Article 5 – Payment

Payment is due immediately and in full at checkout. Accepted methods (depending on country): Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, and local options where applicable:

Payments are processed via Shopify Payments and/or PayPal, both PCI-DSS certified. In the event of payment refusal or anomaly, the order is automatically canceled.


Article 6 – Delivery

Serviced areas: United States, France, Switzerland, Belgium, Luxembourg, Netherlands, Germany, Austria. Some orders may be shipped in multiple parcels.

6.1 Estimated delivery times (excluding 24–72h processing; up to 6 days during high volume)

  • 🇫🇷 France: 5–7 business days
  • 🇨🇭 Switzerland: 5–9 business days
  • 🇧🇪🇱🇺🇳🇱 Belgium / Luxembourg / Netherlands: 5–9 business days
  • 🇩🇪🇦🇹 Germany / Austria: 6–10 business days

Maximum legal EU timeframe: 30 business days from order confirmation.

6.2 Shipping fees

6.3 Tracking & Delivery

Each shipment includes a tracking number sent by email. In case of absence, a delivery notice and/or redelivery may be arranged by the carrier. Risk transfers to the customer upon delivery.


Article 7 – Withdrawal (EU/EEA) & Returns (USA)

EU/EEA: under Articles L.221-18 et seq. of the French Consumer Code, you have 14 days from receipt to exercise your right of withdrawal without justification. Contact: contact@onyxelle.com. Items must be unworn, unwashed, and in original packaging.

United States: returns accepted within 30 days of delivery (unworn, unwashed, in original packaging). Contact us for the appropriate return address (US or international).

Exclusions (all regions): hygiene items (e.g., underwear, swimwear with removed protection), personalized products, and gift cards.

Return shipping: paid by the customer unless due to an error or defective item.

Article 8 – Return Process & Refunds

Once the returned items are received and inspected, a refund is issued within 14 business days using the original payment method. Damaged or non-compliant returns may be refused or credited as store credit.


Article 9 – Non-conformity, Defects & Delivery Issues

If you receive a defective or incorrect item, contact us within 7 days including your order number, description, and photo/video evidence. Depending on the case, we may offer replacement, repair, refund, or credit. For lost packages, a carrier investigation will be opened; if tracking remains unchanged for over 7 business days, a reshipment or full refund will be issued.


Article 10 – Customs & Import Duties

Any visible damage must be noted with the carrier upon delivery. For Switzerland and some international shipments, import duties and local VAT may apply and are payable by the customer (unless stated otherwise at checkout). For returns from abroad, mark the parcel: “Returned goods – No commercial value”.

Article 12 – Personal Data

The collection and use of your data are governed by our Privacy Policy (GDPR, nLPD, CCPA/CPRA). It details purposes, recipients, retention periods, and your rights (access, rectification, deletion, objection, portability, withdrawal of consent).


Article 13 – Legal Warranties

All products are covered by legal warranties of conformity and hidden defects (Articles L.217-3 et seq. of the Consumer Code and 1641 et seq. of the Civil Code). Remedies (repair, replacement, price reduction, cancellation) apply under applicable law.


Article 14 – Liability

ONYXELLE shall not be held liable for non-performance attributable to the customer, an unforeseeable event by a third party, or a force majeure event. In all cases, indirect damages are excluded to the fullest extent permitted by law.


Article 15 – Force Majeure

Events beyond the control of the parties rendering performance impossible, unforeseeable, or irresistible (e.g., strikes, network failures, disasters, administrative decisions, conflicts, pandemics, etc.) are considered force majeure. Obligations are suspended during such events.


Article 16 – Governing Law & Jurisdiction

🇺🇸 United States customers: governed by the laws of the State of New York, subject to mandatory laws of your state of residence. Any dispute shall fall under the jurisdiction of the courts of New York unless otherwise required by law.

🇪🇺 EU customers: governed by French law. In case of dispute, an amicable solution will be prioritized; otherwise, the French courts have jurisdiction. EU ODR platform: ec.europa.eu/consumers/odr.

🇨🇭 Swiss customers: governed by Swiss law, jurisdiction of the Canton of Vaud, subject to mandatory local provisions.


Article 17 – Intellectual Property

All Site content (texts, images, logos, code, databases) is protected. Any reproduction, distribution, or adaptation without written permission is strictly prohibited.

You may view the most recent version of these Terms at any time on this page. ONYXELLE may amend them without notice; changes apply to orders placed after publication.
